Learning Objectives

  • Understanding the Duty. What the duty to accommodate is; its legal sources; and the obligations of employers, employees and unions (where applicable) in the accommodation process.
  • Start & End Points of the Duty. What triggers the duty to accommodate; the employee’s duty to disclose an accommodation need and the employer’s duty to inquire into a need; what a "bona fide occupational requirement" (BFOR) is; and the concept of “undue hardship” and how to assess it.
  • Fulfilling the Duty. A systematic approach to fulfilling the duty to accommodate, including: information gathering; investigating and evaluating options; implementing the accommodation; the role of employee preferences; and a useful accommodation checklist.
