SISIP Claw-Back Class Action Update

This is an update to our June 2011 memo to the Class.

We are pleased to inform you that the Federal Court will hear two issues raised in the Class Action on November 16 and 17, 2011. The hearing will begin at 9:30 am on November 16 and 17, 2011 at The Law Courts located at 1815 Upper Water Street in Halifax, Nova Scotia. The hearing is open to the public and we encourage all interested class members and supporters to attend.

The parties have asked the Court to determine the following two questions:

  1. Does the Government have a legal right under the insurance policy (SISIP 901102) to reduce the Class Member’s SISIP long term disability benefit in the amount of the Class Member’s Pension Act disability pension?
  2. Is the Government miscalculating the Class Member’s SISIP long term disability benefit under the insurance policy (SISIP 901102)?

The Federal Court is able to hear these issues at this early stage because the parties have agreed on the relevant facts.

The Federal Court will not decide all of the issues in Class Action. If the Court decides against the Class on these issues, the Class Action will continue on the remaining issues.

Mise à jour du procès collectif de récupération du RARM

La présente fait suite à notre mémorandum aux membres du procès collectif de juin 2011.

Il nous fait plaisir de vous informer que la Cour fédérale est disposée à considérer deux questions substantives soulevées dans le recours collectif. Les audiences débuteront à 9 h 30 les 16 et 17 novembre 2011 au Palais de justice situé au 1815 Upper Water, Halifax, NouvelleÉcosse. Le public peut assister aux audiences et nous encourageons les membres et partisans du procès collectif à y assister.

Les parties ont demandé à la Cour de déterminer :

1.Selon la police d’assurance (RARM 901102), le Gouvernement a-t-il l’autorité de réduire les prestations d’invalidité de longue durée des membres du procès collectif de récupération du RARM stipulé dans la Loi sur les Pensions des membres du procès collectif?

2.Selon la police d’assurance (RARM 901102), le Gouvernement fait-il erreur dans son calcul de la prestation d’invalidité de longue durée des membres du procès collectif de récupération du RARM?

Étant donné que les parties se sont entendues sur les faits pertinents, la Cour fédérale est disposée à considérer ces deux questions à ce stage du procès.

La Cour fédérale ne prendra pas de décision sur les autres questions du procès collectif. Si la décision de la Cour n’est pas en faveur des membres du procès collectif pour les deux questions ci-haut, le procès collectif continuera pour les autres questions.
