A recent decision by the Federal Court regarding forced medical retirement means that the Treasury Board policy on medical retirement could face scrutiny by the Canadian Human Rights Tribunal to determine if it discriminates against people with disabilities.
Amanda Nash represents Cecilia Carroll, who was working for Service Canada in St. John’s, N.L., and leads a complaint against her employer after she was forced to take medical retirement after being on medical leave since 1993.
