On February 25, 2014, the Federal Court of Canada granted McInnes Cooper’s motion and ordered protection of the anonymity of the the proposed representative plaintiffs in two of the proposed class actions against Health Canada for breaching the privacy of members of its Medical Marihuana Access Program (MMAP).
McInnes Cooper Partner Jane O’Neill successfully brought the motion on the plaintiffs’ behalf. In this March 21, 2014 interview with The Lawyers Weekly, Jane says, “[The proposed plaintiffs] have an absolute right to keep that information private, and Health Canada owed people in the program a duty to keep it private.”
